No problem with that! - Its an obvious thing to do, and I never thought of it first anyway! - The E-Pro effectively uses the same idea.. And I am sure other theremins do likewise.. So on this idea " permission to use it and credit you if it ends up going anywhere commercially " is not applicable! (and would be embarassing!)
